It stated that first responders, including public works professionals, firefighters, police officers, emergency medical technicians, 911 operators, paramedics, and other emergency personnel, stand on the front lines of our communities, selflessly serving and protecting the citizens of Torrington, Wyoming in times of crisis. It also urged all citizens to recognize the substantial contributions first responders make to protecting our national health, safety, and advancing the quality of life for all. Water/Wastewater Supervisor Troxel spoke in support of the proclamation. Councilman Viktorin moved and Councilman Kelly seconded to approve the proclamation as presented. Motion carried unanimously.
Mayor Doby noted the time had arrived for the Mayor and Council to adjourn from regular session and convene as a Board of Adjustment.
Buildings & Grounds Superintendent Estes stated that Glen Shirley is requesting a variance to increase the allowable area of accessory structures from the allowed 700 square feet to 912 square feet for the addition of an unattached garage. He indicated that the property is located at 2818 East B Street. Buildings & Grounds Superintendent Estes commented that there is an existing unattached garage and a garden shed on the property. He stated that the Planning Commission approved the request at their 10-13-26 meeting with the stipulation that Mr. Shirley remove the garden shed before he builds the new garage. Buildings & Grounds Superintendent Estes indicated that he has received no public comment and commented that staff recommends approval with the condition that Mr. Shirley remove the existing garden shed. Mayor Doby opened the public hearing for consideration of the variance request. He asked for public comments in favor of or against the approval of the request. Mr. Shirley spoke in favor of the approval of the request. Councilman Deahl asked Mr. Shirley if he had a problem with removing the garden shed. Mr. Shirley replied no. The public hearing was closed. Councilman Deahl moved and Councilman Viktorin seconded to approve the square footage increase variance request for the property located at 2818 East B Street with the proviso that the garden shed be removed as presented. Motion carried unanimously.
Buildings & Grounds Superintendent Estes stated that the City of Torrington is requesting approval of the preliminary plat for the West 29th Avenue Subdivision containing the City Shop and Purchasing Department buildings, including the dedication of two rights-of-ways (ROWs). He indicated that the road leading up to those buildings that has been used for years is not a legal right-of-way. Buildings & Grounds Superintendent Estes commented that BenchMark has mapped everything out and stated that they put a 60 foot right-of-way coming from West E Street going west over to the end of the City’s property. He indicated that some of Goshen County School District’s (GCSD) property swirls in and out of the proposed right-of-way. Buildings & Grounds Superintendent Estes commented that City staff met with GCSD representatives and stated that GCSD does not want to deed that property to the City of Torrington. He indicated that they are willing, however, to sign off on the plat dedicating that portion of their property as a public right-of-way. Buildings & Grounds Superintendent Estes commented that there are a lot of utilities in that subdivision that are not in dedicated utility easements and stated that this plat will correct that. He indicated that Goshen Irrigation District’s (GID) water line currently sits on City property. Buildings & Grounds Superintendent Estes commented that the proposed plat is going to dedicate a 60 foot right-of-way easement to GID from the City of Torrington by extending West E Street up on the east side of the City Shop. He stated that if GID has to replace their water line in the future for whatever reason, they will have to use the proposed dedicated easement. Buildings & Grounds Superintendent Estes indicated that the Board of Adjustment will see this plat come back to them as a final plat once all of the easements are put into place. He commented that this request will not go back to the Planning Commission as a final plat. Buildings & Grounds Superintendent Estes stated that the Planning Commission did not want to see it again unless substantial changes are made and indicated that he does not foresee that happening. He commented that City staff has not been able to legally get mail or packages delivered to the City owned buildings because there is not a legal street to put a legal address on. Buildings & Grounds Superintendent Estes stated that once the legal right-of-way is officially established with the final plat, a standardized address can be assigned, and the mail delivery issues will be resolved. Mayor Doby opened the public hearing for consideration of the preliminary plat request. He asked for public comments in favor of or against the approval of the request, none were heard. The public hearing was closed. Councilman Viktorin moved and Councilman Deahl seconded to approve the preliminary plat for the West 29th Avenue Subdivision as presented. Motion carried unanimously.
Mayor Doby returned the Mayor and Council to regular session.

Golf Pro Dent stated that the 2027 rates and fees are expected to go up approximately 20%. He indicated that the rates and fees have been structured to give the golfer an opportunity to pay the same golf fees in 2027 as they did in 2025 and 2026. Golf Pro Dent commented that they must, however, pay for their golf fees between the dates of 11-01-26 and 12-31-26. He stated that if the golfer does not take advantage of that window of opportunity, they will have to pay the proposed 2027 fees. Golf Pro Dent indicated that 2028 rates and fees are not listed because there is no guarantee that the 2028 rates and fees will stay the same as they are proposed for 2027. He commented that they certainly will not go down. Councilman Deahl moved and Councilman Kelly seconded to approve the 2027 Golf Rates and Fees as presented. Motion carried unanimously.

Attorney Eddington read by title AN ORDINANCE AMENDING AND RE-ENACTING SECTION 18.16.010. OF THE TORRINGTON MUNICIPAL CODE, 2026 REVISIONS, RELATING TO DISTRICT CLASSIFICATIONS. Councilman Deahl moved and Councilman Viktorin seconded to approve the ordinance on second reading as presented. Motion carried unanimously.
Attorney Eddington read by title AN ORDINANCE AMENDING AND RE-ENACTING SECTION 17.20.010. OF THE TORRINGTON MUNICIPAL CODE, 2026 REVISIONS, RELATING TO PRELIMINARY PLATS. Buildings & Grounds Superintendent Estes stated that the preliminary plat process requires him to publish the request twice in the local newspaper. He indicated that he also has to mail packets to the Planning Commission and mail letters to everyone within 150 feet of the property requesting the plat. Buildings & Grounds Superintendent Estes commented that with the rising costs of everything, the amount that is being collected from the applicant is not covering the publication and mailing costs, so the filing fee is being increased to $400.00. He stated that other changes made to the ordinance include reducing the number of copies that the applicant has to submit from ten copies to eight copies and the addition of a stipulation that requires an electronic PDF copy to also be submitted. Buildings & Grounds Superintendent Estes indicated that the final change made to the ordinance was the removal of the United Telephone Company and the cable television company from the list of signatures that need to be collected before the plat is approved. Councilman Deahl pointed out that with the removal of those two line items, the Electrical Department Head numeral will have to be changed from (7) to (5). Councilman Kelly moved and Councilman Deahl seconded to approve the ordinance on first reading as presented. Motion carried unanimously.
Attorney Eddington read by title AN ORDINANCE AMENDING AND RE-ENACTING SECTION 17.24.010. OF THE TORRINGTON MUNICIPAL CODE, 2026 REVISIONS, RELATING TO FINAL PLATS. Buildings & Grounds Superintendent Estes stated that in the past, both the preliminary and final plats would be presented to the Planning Commission and the Board of Adjustment. He indicated that over the last several years, to reduce the time and cost for the developer, simple plats have been presented as a preliminary plat acting as the final plat. Buildings & Grounds Superintendent Estes commented that now that this is being changed, the final plat will go back to the Planning Commission only if they request to see it. He stated that if they do not request to see it again, then the final plat will go directly to the Board of Adjustment for final approval. Buildings & Grounds Superintendent Estes indicated that the same changes made to the preliminary plat ordinance regarding the increase in the filing fee to $400.00, the reduction in the number of copies that the applicant has to submit to eight copies, and the addition of a stipulation that requires an electronic PDF copy to also be submitted were applied to this ordinance as well. Councilman Viktorin moved and Councilman Kelly seconded to approve the ordinance on first reading as presented. Motion carried unanimously.
Buildings & Grounds Superintendent Estes presented the request for proposal results for the FY27 Dale Jones Swimming Pool Building Heaters Project. He stated that staff recommends awarding the project to Gering Valley Heating and Cooling of Gering, Nebraska in the amount of $11,820.00. Buildings & Grounds Superintendent Estes indicated that after the new heater for the boiler for the main pool was installed, it was up and running for a while, until he got called in on a weekend for a gas leak. He commented that the technician repaired the leak and continued his evaluation, during which he discovered that both building unit heaters had internal components that were severely rusted and leaking gas. Buildings & Grounds Superintendent Estes stated that the technician advised that the units were unsafe for continued operation and required full replacement. He indicated that two proposals were received, one from Zell Heating and Cooling, LLC in the amount of $11,498.00 and one from Gering Valley Heating and Cooling in the amount of $11,820.00. Buildings & Grounds Superintendent Estes commented that although Gering Valley submitted a slightly higher bid, their proposal includes higher-capacity units and more comprehensive replacement work. He stated that specifically, Gering Valley offers a 100,000 BTU unit for the boiler room (compared to Zell’s 60,000 BTU unit) and a 60,000 BTU unit for the pool office (compared to Zell’s 45,000 BTU unit). Buildings & Grounds Superintendent Estes indicated that Gering Valley will also replace the venting for both units, ensuring proper safety performance, warranty and code compliance. He commented that funding for this project is proposed to be taken from the FY27 budget line item 57-40-900 in the amount of $11,820.00. Buildings & Grounds Superintendent Estes stated that this would reduce the amount transferred to the capital reserve for a new pool. Councilman Deahl moved and Councilman Viktorin seconded to award the project to Gering Valley Heating and Cooling of Gering, Nebraska in the amount of $11,820.00 as presented. Motion carried unanimously.
Director of Public Works (DPW) Harkins presented the bid results for the FY27 Crack Fill Project. He stated that staff recommends awarding the bid to Z & Z Seal Coating, Inc. of Laurel, Montana in the amount of $47,160.00 and reserve $27,840.00 (37.1%) for contingency for a project total of $75,000.00. DPW Harkins indicated that the project consists of applying 65,500 LF of hot mix joint sealant to the following City streets: Bighorn Street-Albany Avenue/Hot Springs Street, Campbell Drive-College Drive/ north of Converse Street, Converse Street-Albany Avenue/Johnson Street and Crook Drive-Campbell Drive/Converse Street. He commented that a bid opening was held on 10-14-26 and stated that three bids were submitted in conformance with the bidding requirements. DPW Harkins indicated that the contractor will be given 30 days to complete the project with a substantial completion date of 03-26-27. He commented that funding for the project was established in the FY27 Budget in the amount of $75,000.00. Councilman Viktorin moved and Councilman Deahl seconded to award the bid to Z & Z Seal Coating, Inc. of Laurel, Montana in the amount of $47,160.00 and reserve $27,840.00 (37.1%) for contingency for a project total of $75,000.00 as presented. Motion carried unanimously.
Director of Public Works (DPW) Harkins presented the bid results for the FY28 Chip Seal Placement Project. He stated that staff recommends awarding the bid to Bituminous Paving, Inc. of Ortonville, Minnesota in the amount of $161,210.00 and reserve $18,790.00 (10.4%) for contingency for a project total of $180,000.00. DPW Harkins indicated that the project consists of applying 21,340 SY of liquid asphalt and stone chips with fog coat to the following City streets: Bighorn Street-Albany Avenue/Hot Springs Street, Campbell Drive-College Drive/ north of Converse Street, Converse Street-Albany Avenue/Johnson Street and Crook Drive-Campbell Drive/Converse Street. He commented that the project also includes applying 1,500 SY of double asphaltic surface treatment with fog coat for street construction on West 11th Avenue-Highway 85/West A Street. DPW Harkins stated that a bid opening was held on 10-14-26 and indicated that two bids were submitted in conformance with the bidding requirements. He commented that the contractor will be given 30 days to complete the project with a substantial completion date of 09-17-27. DPW Harkins stated that funding for the project will be established in the FY28 Budget in the amount of $180,000.00. Councilman Viktorin moved and Councilman Kelly seconded to award the bid to Bituminous Paving, Inc. of Ortonville, Minnesota in the amount of $161,210.00 and reserve $18,790.00 (10.4%) for contingency for a project total of $180,000.00 as presented. Motion carried unanimously.
Director of Public Works (DPW) Harkins presented for approval Amendment No. 1 to Addendum No. 2 to the Agreement for Professional Services with M.C. Schaff and Associates, Inc. (MCS) for construction oversight on the FY26 Airport Terminal Building Project in the amount of $1,230.00 per working day. He stated that MCS and the City of Torrington entered into an Agreement for Professional Services on 11-02-22 to provide engineering services for the airport. DPW Harkins indicated that Addendum No. 2 provided for the design, bidding, construction oversight and closeout services for the Airport Terminal Building in the amount of $135,650.20 and was signed on 01-31-25. He commented that Dietzler Construction was awarded the contract on 09-17-25 in the amount of $1,198,377.15 and a notice to proceed was issued on 03-23-26. DPW Harkins stated that Dietzler was given 110 working days to complete the contract and indicated that MCS based their construction oversight cost on that duration. He commented that currently, Dietzler Construction has exceeded the number of working days allowed in the contract and is subject to liquidated damages of $1,230.00 per working day. DPW Harkins stated that MCS set the liquidated damages amount in the contract to allow the owner the ability to pay for the additional construction oversight required to complete the project. He indicated that to date, staff has not received a revised construction schedule from the contractor, so the amount of liquidated damages to be collected cannot be estimated at this time. DPW Harkins commented that there have been no change orders approved on this project. Councilman Deahl moved and Councilman Warren seconded to approve Amendment No. 1 to Addendum No. 2 to the Agreement for Professional Services with M.C. Schaff and Associates, Inc. (MCS) for construction oversight on the FY26 Airport Terminal Building Project in the amount of $1,230.00 per working day as presented. Motion carried unanimously.
Director of Public Works (DPW) Harkins presented for approval Amendment No. 6 to the Agreement for Professional Services with Trihydro Corporation. He stated that staff recommends the approval of Amendment No. 6 to the original Agreement for Professional Services dated 01-27-20 for the design and construction oversight to install a washing press to the new headworks facility. DPW Harkins indicated that this amendment will increase the engineering budget by $50,460.00 and extend the contract duration to 06-30-27. He commented that the issue with the washing press was discovered after running the headworks mechanical bar screen that filters out some of the larger debris. DPW Harkins stated that the screen is supposed to take that larger debris out. He indicated that staff found out that that larger organic type stuff was coming up and being put into a waste container, and commented that it was extremely wet and heavy. DPW Harkins stated that the washer compactor will take the material that the bar screen dumps into it, press it, get the water out of it, and then take those solids and run them through the press and into a metal dumpster which will be located outside of the building. He indicated that this process will make it a lot easier for staff to dispose of those solids at the landfill. DPW Harkins commented that the machine itself is estimated to cost anywhere from $90,000.00 to $100,000.00 and stated that installation will cost 20% - 25% of that, so the estimated total cost is expected to be anywhere from $125,000.00 to $150,000.00. He indicated that there is sufficient funding available for the project to proceed with the purchase and installation of the washing press. Water/Wastewater Supervisor Troxel spoke in support of the approval of Amendment No. 6. Councilman Viktorin moved and Councilman Warren seconded to approve Amendment No. 6 to the Agreement for Professional Services with Trihydro Corporation as presented. Motion carried unanimously.
