The Torrington City Council met in regular session on Tuesday, May 7, 2024 in the City Council Chambers at 436 East 22nd Ave. at 7:00 p.m. Present: Mayor Doby, Council Members Deahl, Kelly, Patterson and Viktorin. Also Present: Clerk/Treasurer Strecker, Attorney Eddington, Director of Public Works Harkins, Chief of Police Johnson, Buildings & Grounds Superintendent Estes, Water/Wastewater Supervisor Troxel and Deputy City Clerk Anaya.
Mayor Doby called the meeting to order.
Councilman Viktorin led the Pledge of Allegiance.
Mayor Doby led the session with informational announcements on the following items: 1. Reminder that the annual spring clean-up is scheduled for 05-04-24 through 05-11-24; 2. Announcement that the sewer lining project is complete. Thank you to all of the residents that were affected during the project for their patience and cooperation; 3. Announcement that May is Mental Health Awareness Month; 4. Mayor Doby urged the citizens of Torrington to continue to enjoy the golf course, parks, sports fields and walking paths owned and maintained by the City of Torrington; 5. Reminder to the public to be cautious and mindful of the presence of bicyclists, scooterists, motorcyclists and pedestrians on the streets as warmer weather approaches; and 6. Request to the public to refrain from using their cell phones while driving.
Councilman Patterson indicated that there are two typographical errors on page one of the minutes. Councilman Patterson moved and Councilman Deahl seconded to approve the consent agenda which includes the minutes from the 04-16-24 Council meeting as amended and all actions therein be ratified. Motion carried unanimously.
Councilman Kelly moved and Councilman Viktorin seconded to approve the agenda as presented. Motion carried unanimously.
Councilman Patterson moved and Councilman Kelly seconded to appoint Mayor Herb Doby as the Official Voting Delegate and Deputy City Clerk Silvia Anaya as the Alternate Delegate for the 2024 Wyoming Association of Municipalities Summer Convention Business Meeting to be held on 06-06-24 in Pinedale, Wyoming. Motion carried unanimously.

Mayor Doby read a proclamation declaring May 5-11, 2024 as Drinking Water Week. It urged each citizen of the City to help protect our source waters from pollution and to practice water conservation, and stated that we are all stewards of the water infrastructure upon which current and future generations depend. Water/Wastewater Supervisor Troxel spoke in support of the proclamation. Councilman Viktorin moved and Councilman Deahl seconded to approve the proclamation as presented. Motion carried unanimously.
Mayor Doby read a proclamation declaring May 19-25, 2024 as Public Works Week in Torrington, Wyoming. It stated that public works professionals focus on infrastructure, facilities and services that are of vital importance to sustainable and resilient communities, and to the public health, high quality of life and well-being of the people of the City of Torrington. It urged all citizens to join with representatives of the American Public Works Association and government agencies in activities, events and ceremonies designed to pay tribute to all public works professionals, engineers, managers and employees, and to recognize the substantial contributions they make to protecting the national health, safety and quality of life. Water/Wastewater Supervisor Troxel spoke in support of the proclamation. Councilman Patterson moved and Councilman Kelly seconded to approve the proclamation as presented. Motion carried unanimously.
Mayor Doby read a proclamation declaring May 19-25, 2024 as Emergency Medical Services Week. It stated that Emergency Medical Services (EMS) provides a vital public health service and that Wyoming’s citizens and visitors benefit daily from the knowledge and skills of these highly-trained individuals, and encouraged the community to observe the designated week in support of all EMS providers. Councilman Deahl moved and Councilman Viktorin seconded to approve the proclamation as presented. Motion carried unanimously.
Mayor Doby read a proclamation declaring May 2024 as Tennis Month in Torrington, Wyoming. It stated that the United States National Lawn Tennis Association (USTA) is the non-profit, national governing body for tennis in the United States, and leads the promotion and growth of the sport at every level of play, from beginners to professionals at the US Open. It also indicated that by increasing the accessibility of tennis for citizens of Torrington of all ages and ability, the USTA has contributed to making the community happier and healthier. Curtis Birkley spoke in support of the proclamation. Councilman Kelly moved and Councilman Patterson seconded to approve the proclamation as presented. Motion carried unanimously.
Attorney Eddington read by title AN ORDINANCE AMENDING AND RE-ENACTING SECTION 13.20.016 OF THE TORRINGTON MUNICIPAL CODE, 2024 REVISIONS, RELATING TO AUTHORIZING AND DIRECTING EXECUTION OF THE AMENDED AND RESTATED TOTAL POWER REQUIREMENTS POWER PURCHASE AGREEMENT BY THE CITY OF TORRINGTON, WYOMING WITH THE MUNICIPAL ENERGY AGENCY OF NEBRASKA. Mayor Doby stated that the proposed ordinance adopts and executes the Service Schedule M, Amended and Restated Total Power Requirements Power Purchase Agreement with the Municipal Energy Agency of Nebraska. Councilman Deahl moved and Councilman Kelly seconded to approve the ordinance on first reading as presented. Motion carried unanimously.
Attorney Eddington read by title AN ORDINANCE AMENDING AND RE-ENACTING SECTION 2.04.010 OF THE TORRINGTON MUNICIPAL CODE, 2024 REVISIONS, RELATING TO REGULAR MEETINGS. Councilman Patterson moved and Councilman Deahl seconded to approve the ordinance on second reading as presented. Voting aye Deahl, Doby and Patterson, nay Kelly and Viktorin, motion carried.
Attorney Eddington read by title AN ORDINANCE ANNEXING WITHIN THE CORPORATE LIMITS OF THE CITY OF TORRINGTON, WYOMING, REAL PROPERTY TO BE KNOWN AS THE “WIRELESS ADDITION.” Councilman Viktorin moved and Councilman Kelly seconded to approve the ordinance on second reading as presented. Motion carried unanimously.
Attorney Eddington read by title AN ORDINANCE AMENDING AND RE-ENACTING SECTION 18.16.020 OF THE TORRINGTON MUNICIPAL CODE, 2024 REVISIONS, RELATING TO THE CITY OF TORRINGTON, WYOMING, AMENDING THE ZONING DISTRICT MAP BY ESTABLISHING “I-1” ZONING FOR A TRACT OF LAND. Councilman Deahl moved and Councilman Kelly seconded to approve the ordinance on second reading as presented. Motion carried unanimously.
Chief of Police Johnson presented for approval a Memorandum of Understanding (MOU) between the State of Wyoming Department of Corrections and the Torrington Police Department. He stated that the purpose of the MOU is to ensure the mutual support between the Torrington Police Department (TPD) and Wyoming Department of Correction’s Wyoming Medium Correctional Institution (WMCI) in terms of manpower, equipment and facilities during emergency situations which may arise at WMCI. Chief of Police Johnson commented that the TPD will retain supervisory oversight of its staff while assisting WMCI and will operate in accordance with the TPD’s policies and procedures. Councilman Patterson indicated that there is a typographical error on page one of the MOU. Chief of Police Johnson stated that he would get that corrected. Councilman Viktorin moved and Councilman Kelly seconded to approve the Memorandum of Understanding (MOU) between the State of Wyoming Department of Corrections and the Torrington Police Department as presented. Motion carried unanimously.
Clerk/Treasurer Strecker requested that the Nepotism Policy be waived for all seasonal Dale Jones Municipal Pool employees for the 2024 season. She explained that due to the demographics of the City, it is nearly impossible for the pool to avoid hiring relatives. Councilman Deahl moved and Councilman Patterson seconded to approve waiving the Nepotism Policy for all seasonal Dale Jones Municipal Pool employees for the 2024 season as presented. Motion carried unanimously.
Clerk/Treasurer Strecker requested that the Nepotism Policy be waived for the Torrington Volunteer Fire Department (TVFD) City of Torrington Secretary Position. She stated that Fire Chief Correa asked the membership if anyone would be interested in fulfilling the duties of the position at the 04-22-24 TVFD Training Meeting and indicated that per the minutes provided by Fire Chief Correa, no one was interested. Fire Chief Correa commented that since no one from the membership was interested in the position, his wife Lauren Correa volunteered to fill the position and to perform the required incident reporting duties. He stated that his wife has already completed the two hour training with the Assistant State Fire Marshal and indicated that she has been filing the incident reports on the new system since 04-03-24 not knowing that this policy waiver was needed. Councilman Kelly inquired if the position is a compensated position. Fire Chief Correa confirmed yes. Councilman Patterson moved and Councilman Viktorin seconded to approve waiving the Nepotism Policy for the Torrington Volunteer Fire Department (TVFD) City of Torrington Secretary Position as presented. Motion carried unanimously.
The bills from 04-17-24 to 05-07-24 were presented for payment. Councilman Patterson moved and Councilman Kelly seconded to approve the bill for Z & W Mill for payment as presented. Councilman Viktorin declared a conflict and abstained from voting. Motion carried. Councilman Kelly moved and Councilman Deahl seconded to approve the remaining bills for payment as presented. Motion carried unanimously.
Mayor Doby asked for public comments, questions or concerns.
Fire Chief Correa briefly updated the Mayor and Council on the calls that the Torrington Volunteer Fire Department responded to in the last couple of weeks.
Mayor Doby reminded residents who will be holding controlled burns to call the dispatch non-emergency line ahead of time to provide relevant information about the burn. The non-emergency phone number is (307) 532-7001.
Chief of Police Johnson stated that 05-04-24 was International Firefighters’ Day. He indicated that we are incredibly fortunate as a community to have the team at the Torrington Volunteer Fire Department (TVFD) serving us. Chief of Police Johnson commented that as an agency they are extremely grateful for their partnership, for their friendship and for their help in keeping the community safe. He stated that they are a team of volunteers who freely give of themselves to provide amazing service to the community. Chief of Police Johnson indicated that every firefighter within the community deserves every bit of appreciation that can be given to them, so he wanted to be sure that they were recognized.
Councilman Patterson announced that he will not be running for re-election at the end of his term. He stated that he has enjoyed serving on the City Council and indicated that he is looking forward to continuing his service until the end of his term in January of 2025. Councilman Patterson commented that he wanted to make the announcement publicly so that anyone interested in serving on the City Council knows that the candidate filing period is May 16-31, 2024. Councilman Deahl thanked Councilman Patterson for his years of service and for his volunteer work. He expressed that Councilman Patterson will be greatly missed. Mayor Doby concurred with Councilman Deah’s remarks and stated that it has been a pleasure serving with Councilman Patterson.
Councilman Viktorin shared with the community that the National Weather Service recorded within the past 24 hours a peak wind gust at the Torrington Municipal Airport of 66 mph.
Mayor Doby adjourned the meeting at 8:34 p.m.
