NOTICE OF APPLICATION FOR
SUMMARY DISTRIBUTION OF DECEDENT’S ESTATE

That Amelia Kae Elben, also known as Amelia Willard Elben, died on the 7th day of December, 2023 in Torrington, Goshen County, Wyoming.
That Kacee Duhon, daughter of the deceased, on the 17th day of January, 2024, filed in the District Court of the Eighth Judicial District, Goshen County, State of Wyoming, her Application for Decree of Distribution, pursuant to W.S.§ 2-1-201 and 2-1-205, praying that the Court adjudge the following described real property be distributed to-wit:


A parcel of land located in Lot 41 of “Green Acres”, Goshen County, Wyoming as filed in Plat Cabinet I at Plat 42 in the Office of the Goshen County Clerk, with this tract being exempt from the Goshen County Subdivision Regulations per Chapter X – Exemptions, Section 2, h “is created by boundary line adjustments where the parcel subject of the sale or other disposition is adjacent to and merged with other lands owned by the grantee”, being more particularly described as follows:

BEGINNING at the Southeast Corner of said Lot 41 which is monumented with a 1 ½” inch aluminum cap marked PLS #3891, set atop a 5/8” diameter x 2’ long rebar;

Thence S 89°29’00” W along the South Boundary of said Lot 41, a distance of 10.00 feet to a point which is monumented with a 1 ½” aluminum cap marked PLS #3891, set atop a 5/8” diameter x 2’ long rebar;

Thence N 00°20’17” W along a line which is parallel with the East Boundary of said Lot 41, a distance of 785.87 feet to a point on the Northerly Boundary of said Lot 41 which point is monumented with a 1 ½” aluminum cap marked PLS #3891, set atop a 5/8” diameter x 2’ long rebar;

Thence N 47°49’54” E along the Northerly Boundary of said Lot 41, a distance of 13.42 feet to the Northeast Corner of said Lot 41 which is monumented with a 1 ½” aluminum cap marked PLS #3891, set atop a 5/8” diameter x 2’ long rebar;

Thence S 00°20’17” E along the Easterly Boundary of said Lot 41, a distance of 794.79 feet to the POINT OF BEGINNING.

With all bearings in this description being based on the Wyoming Department of Transportation control network established for the Torrington-Lingle 1998 construction project, and made relative thereto by plane surveying methods. Said tract contains 0.18 acres, more or less. This description is based on a field survey conducted by Robert W. Taylor, Wyoming P.L.S. #3891, of BenchMark of Torrington, P.C., Torrington, Wyoming.

AND

East 48’ of Lot 42, Green Acres Subd., Goshen County, Wyoming Containing .85 acres m/l

AND

West 52’ of Lot 42, Green Acres Subd., Goshen County, Wyoming Containing .92 acres m/l

That the said Application has been set down for hearing before the Court at the District Courtroom, Goshen County Courthouse, Torrington, Wyoming, at 8:30 a.m. on the 26th day of February, 2024, where all persons interested may appear and object to the granting of the relief;
IF THERE ARE NO OBJECTIONS TO THE APPLICATION AND IF IT APPEARS THAT THE FACTS SET FORTH IN THE APPLICATION ARE NOT IN DISPUTE, the Court will enter into Decree of Distribution setting over the above described real property as set forth above.
