NOTICE IS HEREBY GIVEN that default has occurred under the terms of a Promissory Note (Installment Loan) and Loan Agreement (“Note”) and a Real Estate Mortgage, Security Agreement, Assignment of Rents and Fixture Filing (“Mortgage”), both dated May 7, 2018. The Mortgage was executed and delivered by Mark L. Sturman and Heidi L. Sturman (“Mortgagors”) to Farm Credit Services of America, FLCA (“Mortgagee”) as security for the Note. Said Mortgage was duly recorded on May 17, 2018, at Book 926, Page 98, document 960477, in the records of the office of the County Clerk of Goshen County, State of Wyoming (the “Records”). The Mortgage encumbers the following real property in Goshen County, State of Wyoming (hereinafter the “Property”):

Township 29 North, Range 61 West of the 6th P.M.
Section 5: Lot 4
Section 6: Lots 1, 2, 3, 4, W1/2SE1/4, SE1/4NE1/4

Township 30 North, Range 61 West of the 6th P.M.
Section 31: Lots 1, 2, 3, 4, E1/2W1/2, E1/2

Township 29 North, Range 61 West of the 6th P.M.
Section 5: Lots 1, 2, 3, S1/2NE1/4, S1/2NW1/4, S1/2
Section 6: E1/2SE1/4
Section 7: NE1/4

Due to the aforementioned default (and defaults under other loans), Mortgagee and Farm Credit Services of America, PCA (“PCA”), as plaintiffs, filed a civil action against Mortgagors, as defendants, in the United States District Court for the District of Wyoming (“Court”) on July 6, 2022, at Docket No. 1:22-CV-000147-SWS (the “Lawsuit”). On December 6, 2022, the Court entered a Stipulated Judgment and Decree of Foreclosure (“Decree”), which commanded the sale of the Property as provided herein if Mortgagors failed to pay all amounts due under the Decree to Mortgagee and PCA on or before March 1, 2023. Mortgagors failed to pay such amounts. Under the Decree, the indebtedness due from Mortgagors to Mortgagee, as of the date of this Notice, is $578,802.95, plus attorneys’ fees and expenses recoverable under the Decree. The maximum indebtedness secured by the Mortgage is $500,000.00.

NOW, THEREFORE, pursuant to the Decree, the Sheriff or Deputy Sheriff in and for Goshen County, Wyoming will cause the Property to be sold at public sale to the highest bidder for cash at 10:00 o’clock in the morning on January 5, 2024, at the Goshen County Courthouse, 2125 E. A Street, Torrington, WY 82240, for application on the above-described amounts secured by the Mortgage. Pursuant to the Decree, the sale of the Property is subject to confirmation by the Court. Upon completion of the sale, in accordance with the Decree, Mortgagee shall apply to the Court for an order confirming the sale.

The property being foreclosed upon may be subject to other liens and encumbrances that will not be extinguished at the sale. Any prospective purchaser should research the status of title before submitting a bid.
