The Torrington City Council met in regular session on Wednesday, July 5, 2023 in the City Council Chambers at 436 East 22nd Ave. at 7:00 p.m. Present: Mayor Doby, Council Members Deahl, Kelly, Patterson and Viktorin. Also Present: Clerk/Treasurer Strecker, Attorney Eddington, Director of Public Works/City Engineer Harkins, Chief of Police Johnson and Deputy City Clerk Anaya.
Mayor Doby called the meeting to order.
Councilman Deahl led the Pledge of Allegiance.
Mayor Doby led the session with informational announcements on the following items: 1. Mayor Doby stated that he hopes that everyone had a safe and enjoyable Independence Day; 2. Reminder to all residents and property owners to continue to keep ahead of the growth of weeds in order to proactively avoid a visit from Code Enforcement Officers; 3. Reminder to the public to please refrain from putting garbage in the grass bins as it renders the grass unusable for the making of compost; 4. Reminder that the Rotary Club/City of Torrington additional crosswalk and signage project is complete. Request to the public to please acquaint themselves with the 17 newly marked pedestrian crosswalks. Reminder that pedestrians have the right-of-way; 5. Reminder to the public to be cautious and mindful of the presence of pedestrians, bicyclists and motorcyclists on the streets; and 6. Request to the public to refrain from using their cell phones while driving.
Councilman Viktorin moved and Councilman Kelly seconded to approve the consent agenda which includes the minutes from the 06-20-23 Council meeting as published and all actions therein be ratified. Motion carried unanimously.
Councilman Patterson moved and Councilman Deahl seconded to approve the agenda as presented. Motion carried unanimously.
Mayor Doby presented for approval the appointment of City Officials for the term 07-05-23 to 12-31-23. He stated that normally, City Officials are subject to appointment or re-appointment at the first Council meeting in January of the calendar year, but that due to the circumstance of his election as Mayor, all appointed staff remained in their positions for a six-month period. The six-month period allowed him, as the newly elected Mayor, to evaluate the working relationship with appointed staff. Councilman Patterson moved and Councilman Deahl seconded to approve the appointments of James Eddington as City Attorney, Matthew Johnson as Chief of Police, Lance Petsch as Fire Chief, Lynette Strecker as City Clerk/Treasurer and Jeffrey Harkins as Director of Public Works/City Engineer. Motion carried unanimously.
Mayor Doby presented for approval the following appointments: Safety Committee – L. John Hood and Adrian Flores. Expiration of Terms: 12-31-23. Councilman Deahl moved and Councilman Viktorin seconded to approve the appointments as presented. Motion carried unanimously.
Amy Bomgardner with the Torrington Lions Club requested approval of a special event permit for a Lions Club Festival of Sight to be held on 07-22-23 from 6:30 a.m. to 3:00 p.m. at Pioneer Park. Mayor Doby indicated that the applicant is requesting that the special event permit fee be waived due to the fact that the Torrington Lions Club is a non-profit organization. Tina Garrelts spoke in support of the permit. Councilman Patterson moved and Councilman Kelly seconded to approve the special event permit and to waive the special event permit fee as presented. Motion carried unanimously.
Clayton Kilgore with the Open Barrel Brewing Company requested approval of a catering permit for a Lions Club Festival of Sight to be held on 07-22-23 from 10:00 a.m. to 4:00 p.m. at Pioneer Park. Councilman Patterson moved and Councilman Deahl seconded to approve the catering permit as presented. Motion carried unanimously.
Tiffany Leslie with the Broncho Bar requested approval of a special event permit for a Street Dance to be held on 07-28-23 from 5:00 p.m. to 2:00 a.m. Mayor Doby indicated that the applicant is requesting approval to close the public street on Main Street between 19th Avenue and 20th Avenue. Councilman Viktorin moved and Councilman Kelly seconded to approve the special event permit as presented. Motion carried unanimously.

Councilman Patterson moved and Councilman Deahl seconded to approve the catering permit as presented. Motion carried unanimously.
Attorney Eddington read by title AN ORDINANCE CREATING AND ENACTING SECTION 5.12.065 OF THE TORRINGTON MUNICIPAL CODE, 2023 REVISIONS, RELATING TO RESTRICTIONS ON BAR AND GRILL LICENSES. Councilman Viktorin moved and Councilman Kelly seconded to approve Ordinance No. 1278 as presented on third reading. Motion carried unanimously.
Attorney Eddington read by title AN ORDINANCE AMENDING AND RE-ENACTING SECTION 5.12.025 OF THE TORRINGTON MUNICICPAL CODE, 2023 REVISIONS, RELATING TO MINORS IN LICENSED LIQUOR ESTABLISHMENTS. Councilman Deahl moved and Councilman Kelly seconded to approve Ordinance No. 1279 as presented on third reading. Motion carried unanimously.
Attorney Eddington read by title AN ORDINANCE AMENDING AND RE-ENACTING SECTION 9.24.030. OF THE TORRINGTON MUNICICPAL CODE, 2023 REVISIONS, RELATING TO THE DISCHARGE OF FIREARMS. Councilman Patterson moved and Councilman Deahl seconded to approve the ordinance on second reading as presented. Motion carried unanimously.
Director of Public Works (DPW)/City Engineer Harkins presented for approval Resolution No. 2023-10. He stated that the resolution will authorize the submission of an application to the State Loan and Investment Board for additional ARPA grant funding that the state has made available. DPW/City Engineer Harkins indicated that after discussion with staff, he modified the resolution that was included with the agenda packets to reflect a much larger City match amount. He commented that originally, he combined two projects that are budgeted in the current fiscal year; the Albany Avenue Project which has a budgeted amount of a little over $900,000.00 and the Sewer Lining Project which has a budgeted amount of $780,000.00. DPW/City Engineer Harkins stated that the initial grant application amount request was $1,428,000.00 with a proposed 16% City match which is the minimum match requirement. He indicated that while discussing the proposed project and draft resolution staff felt that going the route of only applying the minimum match requirement to the grant application may not be the best route to pursue. DPW/City Engineer Harkins commented that the revised resolution has a grant amount request of $920,000.00 with a proposed City match of $780,000.00. He stated that the proposed match of $780,000.00 is approximately 46% of the total project cost which should hopefully rank the City higher in the ARPA selection process. Attorney Eddington read Resolution No. 2023-10 authorizing the submission of a Local Government Project ARPA Grants Application to assist in funding the Torrington Water & Sewer Improvements Project in the amount of $920,000.00. Councilman Viktorin moved and Councilman Deahl seconded to approve Resolution No. 2023-10 as revised. Motion carried unanimously.
Clerk/Treasurer Strecker presented for approval the annual write-off of accounts. She stated that the write-offs in utility billing total $10,224.19. The City Council determined the debt as uncollectable and extinguished the debt as an account receivable or asset of the City of Torrington. Councilman Patterson moved and Councilman Kelly seconded to approve the annual write-off of accounts totaling $10,224.19 as presented. Motion carried unanimously.
The bills from 06-21-23 to 07-05-23 were presented for payment. Councilman Kelly moved and Councilman Deahl seconded to approve the bills for payment as presented. Motion carried unanimously.
Mayor Doby asked for public comments, questions or concerns.
Fire Chief Petsch briefly updated the Mayor and Council on the outcome of the Fourth of July Holiday. He stated that the department only received and responded to one call. Fire Chief Petsch also gave a brief update on training that members of the department will be participating in next week that will be held in conjunction with the Torrington Police Department and Torrington Emergency Medical Services.
Mayor Doby adjourned the meeting at 8:03 p.m.
