ORDINANCE NO. 1278
AN ORDINANCE CREATING AND ENACTING SECTION 5.12.065 OF THE TORRINGTON
MUNICIPAL CODE, 2023 REVISIONS, RELATING TO RESTRICTIONS ON BAR AND GRILL LICENSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TORRINGTON, WYOMING:
Section 1: That Section 5.12.065 of the Revised Ordinances of the City of Torrington, Wyoming, 2023 Revisions, be and it is hereby created and enacted to read as follows:
A. Pursuant to Wyoming Statute Section 12-4-413 (g) and (h) all bar and grill license holders shall be required to document and provide written evidence that 60% of their revenue shall be from the combination of food services and entertainment.
B. Entertainment shall be defined as any activity designed to provide diversion or amusement, regardless of the age required for the activity but shall specifically exclude the following:
1) Pornography of any degree; Adult rated movies, media, theatre, audio or communication of any kind; Public indecency as defined by W.S. 6-4-201; Obscenity as defined in W.S. 6-4-301 thru 306; Sexual or nude images or communications of any degree.
2) Gambling as defined by W.S. 6-7-101 (a) (iii).
3) Pari-mutual wagering as defined by W.S. 11-25-102 (vi);
4) Simulcasting as defined by W.S. 11-25-102 (vii);
5) Skill based amusement game as defined by W.S. 11-25-102 (xix);
6) Lottery as defined by W.S. 9-17-103 (vi);
7) Online sports wagering as defined by W.S. 9-24-101 (vi).
This ordinance was passed and approved by the City Council of the City of Torrington on July 5, 2023. All ordinances are available for viewing Monday through Friday 8 A.M. to 4 P.M. at City Hall located at 436 E 22nd Ave., Torrington, WY.
