The Torrington City Council met in regular session on Tuesday, April 18, 2023 in the City Council Chambers at 436 East 22nd Ave. at 7:00 p.m. Present: Mayor Doby, Council Members Deahl, Kelly, Patterson and Viktorin. Also Present: Clerk/Treasurer Strecker, Attorney Eddington, Director of Public Works Harkins, Chief of Police Johnson, Buildings & Grounds Superintendent Estes, Streets & Sanitation Superintendent Hawley and Deputy City Clerk Anaya.
Mayor Doby called the meeting to order.
Councilman Patterson led the Pledge of Allegiance.
Mayor Doby led the session with informational announcements on the following items: 1. Announcement that April 17-21, 2023 is National Work Zone Awareness Week. Request to the public to be cautious and mindful of the presence of construction and utility workers on the streets and on the highways; 2. Reminder to the public to be cautious and mindful of the presence of pedestrians, walkers, runners, bicyclists and motorcyclists on the streets; 3. Request to the public to refrain from using their cell phones while driving; 4. Announcement that May is National Tennis Month; 5. Mayor Doby stated that the City of Torrington provides an abundance of recreational activities and parks. He indicated that there are numerous City parks, baseball/softball fields, soccer fields, a golf course and a dog park. Mayor Doby invited the citizens of Torrington to get out and enjoy all of the parks and activities that the City offers; 6. Mayor Doby recognized Dennis Grubbs, who recently passed away, for his many years of service to the City of Torrington. He extended continued thoughts and prayers to Dennis’ family and friends on behalf of the City of Torrington; 7. Announcement that the west gate at the baler will be open every Saturday through October for residents to dispose of grass clippings, tree limbs and general yard waste; and 8. Announcement that the annual spring clean-up is scheduled for 04-29-23 through 05-06-23.
Councilman Kelly moved and Councilman Viktorin seconded to approve the consent agenda which includes the minutes from the 04-04-23 Council meeting as published and all actions therein be ratified. Motion carried unanimously.
Councilman Patterson moved and Councilman Deahl seconded to approve the agenda as presented. Motion carried unanimously.
Attorney Eddington read a proclamation declaring May 2023 as Tennis Month in Torrington, Wyoming. It stated that the United States National Lawn Tennis Association (USTA) is the non-profit, national governing body for tennis in the United States, and leads the promotion and growth of the sport at every level of play, from beginners to professionals at the US Open. It also indicated that tennis imparts characteristics such as hard work, perseverance, sportsmanship, determination, grit, positive thinking, problem solving, teamwork and social skills to players in the community, and urged the citizens of Torrington to become aware of and involved in Tennis Month activities this May and pursue further tennis opportunities throughout the year. Councilman Viktorin moved and Councilman Deahl seconded to approve the proclamation as presented. Motion carried unanimously.
Chief of Police Johnson presented for approval an addendum to the five special event permits that were approved at the 03-21-23 Council meeting for a series of Summer Concert events that are scheduled to be held on 05-31-23, 06-07-23, 06-14-23, 06-21-23 and 06-28-23. He stated that the location of the Summer Concert series will be changed from City Lot Five to East 21st Avenue from Main Street to slightly east of the City Lot Five restrooms. Chief of Police Johnson indicated that the restrooms and a small section of City Lot Five will also be incorporated during the concert(s). He commented that in order to facilitate the stage setup, East 21st Avenue will be closed from Main Street to just west of the mid-block alley at 3:00 p.m. for each concert. Chief of Police Johnson stated that at 6:00 p.m., the street closure will then be extended to the east edge of the restrooms at City Lot Five. He indicated that the proposed location change is expected to diminish sound levels at the back of Torrington Cinemas but sound levels will still be regularly evaluated to confirm that they do not exceed a consistent average of 80 decibels. Councilman Patterson moved and Councilman Kelly seconded to approve the addendum to the special event permits as presented. Motion carried unanimously.
Heidi Wayland and Jessica Rohrer with Wyoming Child and Family Development gave an update and presentation regarding the developmental disabilities local match.
Nathaniel Hibben with the Torrington Rotary Club addressed the Mayor and Council. He stated that the Rotary Club hopes to plan and build a splash pad at one of the Torrington City parks. Mr. Hibben indicated that a preliminary location that the Rotary Club has discussed as the proposed project site is the southwest corner of Jirdon Park. He commented that Jirdon Park is an ideal location because it is centrally located, it has sufficient separation from the existing swimming pool, it has access to restrooms and it is adjacent to the walking path. Mr. Hibben stated that the Rotary Club has commissioned a conceptual plan from Baker & Associates, Inc. He indicated that the plan does not lay out the specifics as to where the project will be built but more so addresses the infrastructure needs of the project itself. Mr. Hibben commented that before the Rotary Club begins fundraising and planning, it would like to ask the Mayor and Council for general feedback and level of receptiveness to the proposed project, ask if the proposed location of Jirdon Park is a satisfactory location and ask about the requirements and regulations that the project will need to meet in order for the project to be built to City specifications. He stated that the project is intended to be a partnership between the Rotary Club, other service organizations and community minded individuals. Mr. Hibben indicated that in addition to the fundraising component, there will also be a grant application component associated with the project. He commented that once the project is complete, the Rotary Club envisions a situation where the splash pad will be donated to the City for its future use. Mr. Hibben stated that in order to initiate the project, the Rotary Club is seeking for the Mayor and Council to designate a preliminary site as the proposed location for the construction of the splash pad. He indicated that once a specific site is designated, the Rotary Club can formally engage an engineering company to design the splash pad for that specific location and commented that the fundraising component of the project can then commence as well. Councilman Deahl moved and Councilman Viktorin seconded to approve the southwest corner of Jirdon Park as the provisional site for the Torrington Rotary Club Splash Pad Project as presented. Motion carried unanimously.
Mayor Doby noted the time had arrived for the Mayor and Council to adjourn from regular session and convene as a Board of Adjustment.
Buildings & Grounds Superintendent Estes stated that Tom McIntosh requested a setback variance from the required 25’ to 17’ for an 8’ front porch extension. The property is located at 2317 East E Street. He indicated that the Planning Commission approved the request at their 04-11-23 meeting, staff recommends approval and he has received no public comment. Mayor Doby opened the public hearing for consideration of the setback variance request. He asked for public comments for or against the approval of the request, none were heard. The public hearing was closed. Councilman Patterson moved and Councilman Kelly seconded to approve the setback variance request for the property located at 2317 East E Street as presented. Motion carried unanimously.
Buildings & Grounds Superintendent Estes stated that Roxane Lira requested approval of a zone change from R-1 to R6-A on Tracts A-1 and A-2 of the Lopez Addition 3rd Filing. He indicated that Ms. Lira is asking to return the property to its original zoning of R6-A to be allowed to build a new home on the property with limited animals. Buildings & Grounds Superintendent Estes commented that the property was rezoned many years ago to the most restrictive zone of R-1 which does not allow for metal structures or animals. Mayor Doby opened the public hearing for consideration of the zoning request. He asked for public comments in favor of or against the approval of the zoning request, none were heard. The public hearing was closed. Councilman Deahl moved and Councilman Patterson seconded to approve the zone change for Tracts A-1 and A-2 of the Lopez Addition 3rd Filing from R-1 to R6-A as presented. Motion carried unanimously.
Buildings & Grounds Superintendent Estes stated that Roxane Lira requested a setback variance on the south and west side from the required 25’ to 15’ on Tract A-1 of the Lopez Addition 3rd Filing. He explained that building a new home on a corner lot with setback requirements on two sides really impedes the building footprint. Buildings & Grounds Superintendent Estes indicated that Ms. Lira is requesting the setback variances in order to line up to the property directly to the west. He commented that staff recommends approval and that he has received no public comment. Mayor Doby opened the public hearing for consideration of the setback variance requests. He asked for public comments for or against the approval of the requests, none were heard. The public hearing was closed. Councilman Viktorin moved and Councilman Patterson seconded to approve the setback variance requests for Tract A-1 of the Lopez Addition 3rd Filing as presented. Motion carried unanimously.
Mayor Doby returned the Mayor and Council to regular session.
Director of Public Works (DPW) Harkins presented for approval the Airport Board’s recommendation to terminate the Fuel Supply Contract with CitysServiceValcon, LLC to be effective on 10-01-23. He stated that at the 04-11-23 Airport Board meeting, it was recommended that the City of Torrington no longer participate in the Phillips 66 branding of the fuel dispensed at the Torrington Municipal Airport. DPW Harkins indicated that the major reason why the termination request is being made is to allow the airport to shop independent distributors to get the best price for the fuel needed. He commented that currently the City is locked into using CityServiceValcon and stated that they are rarely the low-cost provider. DPW Harkins indicated that the current Fuel Supply Contract between the City and CityServiceValcon was entered into on 10-01-17. He commented that the contract allowed the City to advertise its fuel being dispensed at the airport as Phillips 66 branded fuel and allowed the City to enroll in the Phillips 66 Branded Airport Dealers Excess Liability Insurance Program. DPW Harkins stated that the program provides the City with excess liability insurance coverage over and above the City’s own liability insurance coverages in the amount of $50,000,000.00 per occurrence. He indicated that the City plans to maintain this insurance even without the Phillips 66 branding. Councilman Viktorin moved and Councilman Deahl seconded to approve the termination of the Fuel Supply Contract with CityServiceValcon, LLC as presented. Motion carried unanimously.
Streets & Sanitation Superintendent Hawley presented the bid results for a New Side Dump Refuse Truck Complete. He stated that the bid received from Peterbilt of Wyoming of Casper, Wyoming was the only bid that was submitted. Streets & Sanitation Superintendent Hawley indicated that staff recommends awarding the bid to Peterbilt of Wyoming in the amount of $331,500.00. He commented that the estimated delivery time of the unit is 260 days. Councilman Patterson moved and Councilman Deahl seconded to award the bid to Peterbilt of Wyoming of Casper, Wyoming in the amount of $331,500.00 as presented. Motion carried unanimously.
Attorney Eddington read by title AN ORDINANCE REPEALING PRIOR ORDINANCE #1097 DATED JULY 6, 2010 AND FILED AT BOOK 799 PAGE 149 OF THE GOSHEN COUNTY, WYOMING REAL ESTATE RECORDS. He stated that Ordinance No. 1097 contains an incorrect legal description and indicated that the proposed ordinance is a housekeeping matter of cleaning up this ordinance of record by repealing it. Councilman Patterson moved and Councilman Viktorin seconded to approve the ordinance on first reading as presented. Motion carried unanimously.
The bills from 04-05-23 to 04-18-23 were presented for payment. Councilman Kelly moved and Councilman Deahl seconded to approve the bills for payment as presented. Motion carried unanimously.
Mayor Doby asked for public comments, questions or concerns.
Streets & Sanitation Superintendent Hawley requested to the public to please refrain from putting garbage in the grass bins as it renders the grass unusable for the making of compost.
Fire Chief Petsch briefly updated the Mayor and Council on the calls that the Torrington Volunteer Fire Department responded to in the last couple of weeks. He also reminded residents who will be holding controlled burns to call the dispatch non-emergency line ahead of time to provide relevant information about the burn such as the location of the burn, when the burn will begin and when the burn will end.
Mayor Doby adjourned the meeting at 8:29 p.m.
