STATUTORY NOTICE TO CREDITORS
PURSUANT TO W.S. § 4-10-507
TO: Any creditor of Marilyn O. Simmons or of the Marilyn O. Simmons Trust dated September 7, 2005 (the “Trust”), you are hereby notified as follows:
1. The Trust was established by Marilyn O. Simmons, as Trustmaker. Marilyn O. Simmons was the initial Trustee of the Trust, which was revocable during the Trustmaker’s lifetime. Marilyn O. Simmons passed away on May 7, 2021, while the Trust was still in effect. Upon the death of Marilyn O. Simmons, the Trust became irrevocable. The Trust was created in the State of Wyoming. The Successor Trustees are Wyoming residents and are administering the Trust in Wyoming. W.S. § 4-10-108.
2. The names and addresses of the Successor Trustees of the Marilyn O. Simmons Trust dated September 7, 2005, are:
3. All creditors of Marilyn O. Simmons or of the Marilyn O. Simmons Trust dated September 7, 2005, shall make all claims, in writing, to the Successor Trustees at the above addresses within one hundred twenty (120) days after the date of the first publication of this notice.
4. The time allowed for creditors to commence a proceeding to contest the validity of a trust or of the proposed distribution of the trustee is one hundred twenty (120) days from the date of the first publication of this notice.
5. This notice is given in accordance with the provisions of W.S. § 4-10-507.
6. A creditor failing to file a claim against the assets of the Marilyn O. Simmons or of the Marilyn O. Simmons Trust dated September 7, 2005 within one hundred twenty (120) days or to commence a judicial proceeding to contest the validity of the Trust or any amendment thereto within the time provided by law is forever prohibited from making any claim or commencing any judicial proceeding against the settlor/grantor of the Trust.
