NOTICE OF INTENT TO REQUEST THE RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be
undertaken by the Town of Yoder, Wyoming.
REQUEST FOR THE RELEASE OF FUNDS
On or about October 17,2020 the Town of Yoder, Wyoming will submit a request to the U.S. Department of Housing and Urban Development or Wyoming Business Council, as applicable on behalf of Town of Yoder for the release of Community Development Block Grant funds under Title 1 of the Housing and Community Development Act of 1974, as amended, to undertake a project known as Yoder Water Improvements. The location of the project will include the corporate limits of the Town of Yoder within the following sections: Section 34, Township 23 North, Range 62; and Section 3, Township 22N, Range 62 West of the 6th Principal Meridian.
FINDING OF NO SIGNIFICANT IMPACT
The Town of Yoder, Wyoming has determined that the project will have no significant
impact on the human environment. An Environmental Impact Statement under the National
Environmental Policy Act of 1969 (NEPA), therefore, is not required. Additional project
information is contained in the Environmental Review Record (ERR) on file at Yoder Town Hall, 321 Main Street, Yoder, WY 82244 and may be examined or copied weekdays 7:45 A.M. to 12:45 P.M. Monday through Thursday, and 7:45 A.M. to 11:45 A.M. on Friday.
PUBLIC COMMENTS
Any individual, group, or agency disagreeing with this determination or wishing to comment on
the project may submit written comments to Baker & Associates, Inc., 1401 East 'M' Street, Torrington, Wyoming 82240. All comments received by November 2, 2020 will be considered by the Town of Yoder, Wyoming prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
RELEASE OF FUNDS
The Town of Yoder, Wyoming certifies to the U.S. Department of Housing and Urban
Development or Wyoming Business Council, as applicable that Norman Feagler in His capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The U.S. Department of Housing and Urban Development’s or Wyoming Business Council, as applicable approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Town of Yoder to use Program funds.
OBJECTIONS TO THE RELEASE OF FUNDS
The U.S. Department of Housing and Urban Development or Wyoming Business Council, as
applicable will accept objections to its release of funds and the Town of Yoder's certification
for a period of fifteen days following the anticipated submission date or its actual receipt of the
request (whichever is late) only if they are made on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Town of Yoder; (b) the Town of Yoder has omitted a step or failed to make a decision or finding required by U.S. Department of Housing and Urban Development regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before the approval of a release of funds by the U.S. Department of Housing and Urban Development or Wyoming Business Council, as applicable; or (d) another Federal agency, acting pursuant to 40 CFR part 1504, has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures of 24 CFR Part 58 and shall be addressed to the U.S. Department of Housing and Urban Development, Region VIII Office, 8ADE, 1670 Broadway Street, Colorado 80202-4801, or Wyoming Business Council, 214 West 15th Street, Cheyenne, WY 82002-0240, as applicable. Potential objectors should contact the U.S. Department of Housing and Urban Development or Wyoming Business Council, as applicable to verify the actual last day of the objection period.
