    The Torrington City Council met in regular session on Tuesday, March 7, 2023 in the City Council Chambers at 436 East 22nd Ave. at 7:00 p.m. Present: Mayor Doby, Council Members Deahl, Kelly, Patterson and Viktorin. Also Present: Clerk/Treasurer Strecker, Attorney Eddington, Director of Public Works Harkins, Chief of Police Johnson, Emergency Management Coordinator Kenyon and Deputy City Clerk Anaya.
        Mayor Doby called the meeting to order.
        Councilman Deahl led the Pledge of Allegiance.

    Mayor Doby led the session with informational announcements on the following items: 1. On behalf of the City of Torrington, Mayor Doby extended his deepest sympathy and condolences to the family of Mayor Rene Kemper of Douglas, Wyoming who recently passed away. He extended thoughts and prayers to the City of Douglas and the citizens of Douglas as well; 2. Thank you to Clerk/Treasurer Strecker and Director of Public Works Harkins for representing the City of Torrington at the State Loan and Investment Board meeting that was held the week of February 27th. Announcement that the City was awarded an additional $450,000.00 in ARPA (American Rescue Plan Act) funds to assist in funding the Torrington Well #16 Connection Project. Mayor Doby thanked the Council for approving the resolution in support of submitting a grant application for that specific project which was successful to that degree. He also thanked Wyoming State Treasurer Meier for making the motion to grant the additional funds to the City; 3. Legislative session update. Mayor Doby thanked Goshen County Senator Steinmetz, Goshen County Representative Smith and Goshen County Representative Slagle for their hard work and service; 4. Weather updates; 5. Compliments to Streets & Sanitation Superintendent Hawley and his staff for clearing the streets during the most recent winter/snow storm. Compliments to other City staff members who cleared sidewalks and parking lots during the most recent winter/snow storm. Compliments to the citizens and property owners of Torrington for their snow removal efforts; 6. Reminder to the public to be cautious while navigating slick streets during winter months; and 7. Request to the public to refrain from using their cell phones while driving.
        Councilman Kelly moved and Councilman Deahl seconded to approve the consent agenda which includes the minutes from the 02-21-23 Council meeting as published and all actions therein be ratified. Motion carried unanimously.
Councilman Patterson moved and Councilman Viktorin seconded to approve the agenda as presented. Motion carried unanimously.
Paul Stille with Leo Riley & Co. presented the Auditor’s Financial Report for FY 2022 ending 06-30-22. He briefly reviewed some of the major highlights of the report which included retirement contributions, the statement of activities, the accounting for the ARPA (American Rescue Plan Act) funding not yet spent, net changes in fund balances, the statement of net position – proprietary funds, the statement of revenue, expenses and changes in fund net position – proprietary funds, the statement of cash flows – proprietary funds, investments, fixed assets, long-term debt and the independent auditor’s report on internal control over financial reporting and on compliance. Councilman Patterson moved and Councilman Kelly seconded to accept the financial report as presented. Motion carried unanimously.
Attorney Eddington read by title AN ORDINANCE AMENDING AND RE-ENACTING SECTION 12.32.082 OF THE TORRINGTON MUNICIPAL CODE, 2023 REVISIONS, RELATING TO AIRPORT GROUND LEASE. Councilman Deahl moved and Councilman Viktorin seconded to approve Ordinance No. 1272 as presented on third reading. Motion carried unanimously.
Attorney Eddington read by title AN ORDINANCE CREATING AND ENACTING SECTION 13.20.040 OF CHAPTER 13.20, OF THE TORRINGTON MUNICIPAL CODE, AUTHORIZING AND DIRECTING EXECUTION OF THE GREEN ENERGY PROGRAM SUBSCRIPTION CONFIRMATION BY THE CITY OF TORRINGTON, WITH THE MUNICIPAL ENERGY AGENCY OF NEBRASKA. Councilman Patterson moved and Councilman Kelly seconded to approve the ordinance on second reading as presented. Motion carried unanimously.
Attorney Eddington read by title AN ORDINANCE REPEALING SECTION 13.24.030. OF THE TORRINGTON MUNICIPAL CODE, 2023 REVISIONS, RELATING TO DEPOSITS. Clerk/Treasurer Strecker stated that this particular section of the code was passed and approved in 2002, and indicated that in 2017 the City of Torrington worked with the Public Service Commission (PSC) to update all of its policies for the electrical fund. She commented that this section should have been repealed in 2017 when all of the City’s policies were updated but that it was apparently inadvertently missed. Clerk/Treasurer Strecker stated that the proposed ordinance will get rid of the conflicting information and will ensure that only the most current information that was adopted in 2017 and also approved by the PSC is published. Councilman Viktorin moved and Councilman Deahl seconded to approve the ordinance on first reading as presented. Motion carried unanimously.
Attorney Eddington read Resolution No. 2023-7. Emergency Management Coordinator (EMC) Kenyon stated that the resolution will adopt the Wyoming Region 7 Hazard Mitigation Plan 2023 Update as the City of Torrington’s multi-hazard mitigation plan. He indicated that mitigation planning is a process used by the state and local governments to identify those potential risks and vulnerabilities associated with natural disasters in a designated region and to develop mitigation strategies to reduce or eliminate such risks. EMC Kenyon commented that the plan is updated no less than every five years and stated that the City is not obligated to adopt the plan as its mitigation plan, however, if the City does not participate in the plan it will be precluded from being eligible to receive any type of mitigation funding. Councilman Kelly moved and Councilman Patterson seconded to approve Resolution No. 2023-7 as presented. Motion carried unanimously.
Mayor Doby presented for approval the 2023 Swimming Pool Rates. He stated that he is recommending that the rates stay the same as calendar year 2022. Mayor Doby indicated that after comparing the rates that were approved for the 2022 season to the Town of Lingle and to the Town of Guernsey, he does not feel that there is a real need to increase the rates for the upcoming season. Councilman Viktorin moved and Councilman Deahl seconded to keep the Swimming Pool Rates for the 2023 calendar year the same as 2022 as presented. Motion carried unanimously.
Clerk/Treasurer Strecker presented for approval the 2023 Power Cost Adjustment (PCA). She stated that a PCA allows the City to keep up with the cost of wholesale power and electrical rates. Clerk/Treasurer Strecker commented that the proposed 2023 PCA has been filed with the Public Service Commission and is pending approval. She indicated that the proposed PCA will result in a reduction of $0.000202 in electrical rates that will go into effect as of 04-01-23. Councilman Kelly moved and Councilman Patterson seconded to approve the 2023 Power Cost Adjustment (PCA) as presented. Motion carried unanimously.
The bills from 02-22-23 to 03-07-23 were presented for payment. Councilman Kelly moved and Councilman Viktorin seconded to approve the bills for payment as presented. Motion carried unanimously.
Mayor Doby asked for public comments, questions or concerns.
Councilman Patterson commended all employees that are involved in the handling of City finances. He stated that it is extremely gratifying to receive a clean audit back from the auditor. Mayor Doby concurred with Councilman Patterson’s remarks.
Mayor Doby adjourned the meeting at 8:33 p.m.
