The Torrington City Council met in regular session on Tuesday, November 3, 2020 in the City Council Chambers at 436 East 22nd Ave. at 7:00 p.m. Present: Mayor Adams, Council Members Hill, Kinney, Law and Patterson. Also Present: Clerk/Treasurer Strecker, Attorney Eddington, Director of Public Works Harkins, Chief of Police Johnson, Building Official Estes, Electrical Supervisor Youtz, Water/Wastewater Supervisor Troxel and Deputy City Clerk Anaya.
Mayor Adams called the meeting to order.
Councilman Patterson led the Pledge of Allegiance.
Mayor Adams led the session with informational announcements on the following items: 1. COVID-19 updates and recommendations; 2. Free COVID-19 test kits available at www.vaulthealth.com; 3. Request for continued local business community support; 4. Request for community assistance with the clean-up/removal of leaves on personal property. Leaves can be placed in the grass dumpsters or they can be hauled to the baler site for disposal. Grass dumpsters will be picked up after 11-15-20; 5. Consensus Revenue Estimating Group (CREG) Report update; 6. Progress on projects within the City; and 7. Thank you to all of the citizens that voted in the General Election.
Councilwoman Hill moved and Councilman Kinney seconded to approve the consent agenda which includes the minutes from the 10-20-20 Council meeting as published and all actions therein be ratified. Motion carried unanimously.

Mayor Adams requested approval to amend the agenda as follows:
•    Add Wyoming Rural Water Apprenticeship Program to the Action Items List.
Councilman Law moved and Councilman Patterson seconded to approve the agenda as amended. Motion carried unanimously.  
Patrick Zimmerer with Table Mountain Vineyards, LLC requested approval of a catering permit for a Moose Mercantile Sip ‘n See event to be held on 11-12-20 from 3:00 p.m. to 8:00 p.m. at 134 East 21st Avenue. Councilwoman Hill moved and Councilman Law seconded to approve the catering permit as presented. Motion carried unanimously.
Electrical Supervisor Youtz stated that the City of Torrington’s Apprenticeship Program has been registered with the U.S. Department of Labor for several years and commented that it has been extremely successful in training several City employees to master the skill sets required of the job. Attorney Eddington read a proclamation declaring November 8-14, 2020 as National Apprenticeship Week in the City of Torrington. It raises awareness of the vital role apprenticeships provide in creating a qualified and highly-skilled workforce in diverse industries, in the City of Torrington and across the nation. Councilman Kinney moved and Councilwoman Hill seconded to approve the proclamation as presented. Motion carried unanimously.
Water/Wastewater Supervisor Troxel presented the Wyoming Rural Water Apprenticeship Program for approval. He briefly summarized the program as it had previously been discussed in depth at a Work Session held by the City Council on 11-02-20. Water/Wastewater Supervisor Troxel stated that the City of Torrington will serve as the Participating Employer, and will provide the on-the-job training to the apprentice by a mentor and pay the apprentice’s wages. Councilman Kinney moved and Councilwoman Hill seconded to approve the Wyoming Rural Water Apprenticeship Program as presented. Motion carried unanimously.
Attorney Eddington read by title AN ORDINANCE AMENDING AND RE-ENACTING SECTION 3.04.045. A OF THE TORRINGTON MUNICIPAL CODE, 2020 REVISIONS, RELATING TO WATER HOOK-UP FEES. Councilman Kinney moved and Councilman Patterson seconded to approve Ordinance No. 1229 as presented on third reading. Motion carried unanimously.
Attorney Eddington read by title AN ORDINANCE AMENDING AND RE-ENACTING SECTION 3.04.022. OF THE TORRINGTON MUNICIPAL CODE, 2020 REVISIONS, RELATING TO SEWER HOOK-UP FEES. Councilman Law moved and Councilwoman Hill seconded to approve Ordinance No. 1230 as presented on third reading. Motion carried unanimously.
Attorney Eddington read by title AN ORDINANCE AMENDING AND RE-ENACTING SECTION 18.16.020 OF THE TORRINGTON MUNICIPAL CODE, 2020 REVISIONS, RELATING TO THE CITY OF TORRINGTON, WYOMING, AMENDING THE ZONING DISTRICT MAP BY ESTABLISHING “R-2A” ZONING FOR A TRACT OF LAND. Building Official Estes stated that the south third of the two lots located at 902 and 910 Sheridan Street did not get legally zoned by ordinance in previous re-platting attempts, therefore the proposed ordinance is a housekeeping effort to clean-up the zoning map. Councilman Patterson moved and Councilman Kinney seconded to approve the ordinance on first reading as presented. Motion carried unanimously.

Building Official Estes stated that the Halco 2nd Addition was annexed in 1972 but never legally zoned by ordinance, therefore the proposed ordinance is a housekeeping effort to clean-up the zoning map. Councilwoman Hill moved and Councilman Kinney seconded to approve the ordinance on first reading as presented. Motion carried unanimously.
The bills from 10-21-20 to 11-03-20 were presented for payment. Councilman Law moved and Councilman Patterson seconded to approve the bills for payment as presented. Motion carried unanimously.
Mayor Adams asked for public comments, questions or concerns.
Dennis Kelly addressed the Mayor and Council. He inquired about the Wyoming Ethanol Facility Project. In specific, he asked about the hazardous material that Panhandle Coop will have on site and questioned which entity would be liable in the event of a hazardous material spill. Attorney Eddington replied that the lease agreement between the City of Torrington and Panhandle Coop states that Panhandle Coop shall defend and indemnify the City of Torrington from all injuries, demands and claims arising from their activities, product and material at all times. Mr. Kelly inquired if the City will receive a certificate or documentation stating that the property is clean prior to the purchase of the facility being finalized. Attorney Eddington responded that the appraisal of the property is currently in the works and commented that a condition of property report will be included with the appraisal.
Councilwoman Hill moved and Councilman Kinney seconded to adjourn to executive session to discuss personnel. Motion carried unanimously.
Councilman Law moved and Councilman Patterson seconded to return the Council to regular session. Motion carried unanimously.
Councilman Kinney moved and Councilwoman Hill seconded to approve a Part-Time Street and Sanitation Worker as presented. Motion carried unanimously.
Councilman Kinney moved and Councilman Patterson seconded that there being no further business to come before the Mayor and Council to adjourn at 8:14 p.m. Motion carried unanimously.
