ORDINANCE NO. 1213

AN ORDINANCE AMENDING CHAPTER 10.40. OF THE TORRINGTON MUNICIPAL CODE, 2019 REVISIONS, BY CREATING SECTIONS 10.40.100., 10.40.110., 10.40.120., 10.40.130. AND 10.40.140. RELATING TO PROHIBITED ENGINE NOISE IN THE CITY OF TORRINGTON, WYOMING.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TORRINGTON, WYOMING:

Section 1.  That Chapter 10.40. of the Revised Ordinances of the City of Torrington, Wyoming, 2019 Revisions, be and is hereby amended by creating and enacting the following sections:

10.40.100. Unnecessary engine noises prohibited.

It is unlawful for the operator of any motor vehicle in the City limits to race their engine, backfire said engine or cause any other unnecessary engine noise or excessive smoke to be produced as to cause a public nuisance or disturbance.

10.40.110. Defective mufflers and exhaust systems prohibited.


It is unlawful for a person to operate a motor vehicle in the City limits, if the vehicle has a defect in the exhaust system which affects sound reduction of the motor, is not equipped with a muffler or other noise dissipative device or is equipped with a cutout, bypass, amplifier or a similar device to limit noise.

10.40.120. Use of un-muffled engine compression brake prohibited.

No person shall operate or use any un-muffled vehicle compression brake within City limits. The use of compression brakes with straight pipes is prohibited within City limits.

10.40.130. Abatement; notice.

The City code enforcement officer shall investigate all complaints regarding this ordinance and notify in writing any person responsible for creating or maintaining a noise violation, as stated in this ordinance. The notice shall describe the cause, things, acts or uses that are deemed to constitute a violation of this ordinance and that the person shall have ten (10) days to abate or fix the noise problem or the person may be cited for a violation of this ordinance. This abatement/notice shall not apply to any law enforcement officer that personally observes or witnesses any violation of this ordinance-the law enforcement officer retains the discretion to cite the person for a violation of this ordinance immediately.
    
10.40.140. Violation - penalty.

Any person, firm or corporation who shall violate these sections shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not to exceed $750.00 and shall pay costs of prosecution.

Section 2.  This ordinance shall be in full force and effect from and after its passage and approval and publication as required by law.
